1. Definition of Terms

1.1 “You” and “Your”: Refers to the person ordering goods from KM Food Store, who must be over 18 years of age.
1.2 “KM Food Store”, “We”, “Us”, or “Our”: Refers to KM Food Store.
1.3 “Account”: Refers to your details and shopping history, which is created when you register to shop through our grocery site.
1.4 “Collect”: Refers to you collecting, or the person you have asked to collect on your behalf, the goods that you order from KM Food Store.
1.5 “Deliver”: Refers to us (or a third-party delivery nominated by us) delivering the goods you order to the address stated in your order (provided that address is within our delivery area). “Delivery” and “Delivered” shall be interpreted accordingly.
1.6 “Express”: Refers to same-day delivery or collection. “Express Delivery” and “Express Collection” shall be interpreted accordingly.
1.7 “Site” or “Website”: Refers to our grocery website at http://www.kmfoodstore.com/.

2. Terms of Use

2.1 Use of and Access to the Site

2.1.1 From time to time, it may be necessary for us to carry out maintenance on the Site, which may result in occasional downtime.
2.1.2 We cannot promise that the Site will be uninterrupted or error-free or that defects will be corrected.
2.1.3 You may use the Site to browse and buy goods from us and manage your account but not for any other purpose.
2.1.4 You must not use your KM Food Store username and password combination to access the Site on behalf of any commercial organization.

2.2 Content of the Site

2.2.1 We may update the Site and its content from time to time. However, we make no representations or guarantees that any content on the Site is accurate, complete, or up to date.
2.2.2 We do not guarantee that the Site or its content will be free from errors or omissions.
2.2.3 All rights, including intellectual property rights, in any data on the Site will automatically be owned by KM Food Store. You agree not to use such data without our express permission.
2.2.4 You are responsible for configuring your technology and using your own virus protection software.
2.2.5 You must not misuse the Site by knowingly introducing viruses, trojans, worms, or other harmful material. Attempting unauthorized access or denial-of-service attacks is a criminal offence under the Computer Misuse Act 1990. We will report breaches to law enforcement.

2.3 Governing Law

These terms of use are subject to UK law and the exclusive jurisdiction of the UK courts.

2.4 Changes to These Terms

If we make any changes to these terms, we will notify you via our Site. Continued use of the Site constitutes acceptance of the updated terms.

3. Terms of Sale

3.1 Becoming a Customer

3.1.1 To place an order, you must be over 18 years of age, require delivery within our delivery area, and have a valid credit or debit card in your name.
3.1.2 When registering, you will create a username and password for your account. Alternatively, you may checkout as a guest (some features will be unavailable). You are responsible for maintaining the confidentiality of your login details.
3.1.3 We reserve the right to decline a new registration or suspend/disable your account at our discretion.

3.2 Our Contract

3.2.1 An order acknowledgment email will confirm what you have ordered but does not constitute acceptance. A legally binding contract forms once delivery or collection is completed.
3.2.2 These terms regulate the supply of goods by KM Food Store. Any other terms are excluded unless required by law.
3.2.3 Failure to enforce any term shall not constitute a waiver of our rights.

3.3 Price

3.3.1 The price payable is that shown on the Site at the time you place your order. Later promotions or discounts do not apply retroactively.
3.3.2 Packaging and postage costs (including single-use carrier bags) will be displayed in your “Trolley” before checkout.

3.4 Order Cancellation and Returns

3.4.1 Orders are processed promptly and usually cannot be cancelled. Contact us within one hour of placing your order to request cancellation.
3.4.2 Returns Policy: You may return goods if they are damaged, defective, incorrect, or if you change your mind within 14 days (per the Consumer Contracts Regulations 2013).
3.4.3 Returns should be sent via Royal Mail Tracked 48 or another tracked postal service. Return postage is your responsibility unless goods are faulty or incorrect.
3.4.4 Items may also be returned in-store within 14 days with proof of purchase.
3.4.5 Refunds are processed within 14 days of receiving returned goods and include the purchase price plus standard delivery (where applicable).
3.4.6 Damaged or incorrect items must be reported within 48 hours of delivery, with photos where possible.
3.4.7 Items Not Eligible for Return:

1) Opened or unsealed packages (unless faulty)

2) Items returned after 14 days without prior agreement

 3.4.8 We do not offer exchanges. Please return unwanted items for a refund and place a new order.

3.5 Stock Availability and Substitutions

3.5.1 While we strive to maintain stock, substitutions may be offered if items are unavailable.

3.6 Delivery of Your Goods

3.6.1 Method and Timelines: Deliveries are via Royal Mail 48-Hour Tracked Delivery (UK only). Typical delivery is within 2 working days of dispatch.
3.6.2 Charges: Calculated at checkout based on weight and size.
3.6.3 Delivery Area: UK addresses only. Orders outside this area will be cancelled and refunded.
3.6.4 Address and Safe Place Requests: Ensure your delivery address is accurate. We are not responsible for parcels left at your request.
3.6.5 Delays: We are not liable for delays beyond our control (e.g., postal strikes, weather).
3.6.6 Ownership and Risk: Risk transfers upon delivery. Notify us within 48 hours if items are missing or damaged.

3.7 Collection of Your Goods

3.7.1 In-Store Collection: You will be notified when your order is ready.
3.7.2 Collection Times: During store opening hours (see Site). Bring ID and your order confirmation.
3.7.3 Collection Period: Orders must be collected within 7 days. Uncollected orders may be cancelled.
3.7.4 Ownership and Risk: Risk transfers upon collection.

3.8 Limitation of Liability

3.8.1 We are not liable for indirect, consequential, or profit losses.
3.8.2 Goods are sold for consumer use only. We are not liable for business-related losses.
3.8.3 Except for faulty goods, liability ceases after delivery or collection.

3.9 Card Usage

3.9.1 Payment Methods: Payments must be made using a European-based credit/debit card or PayPal.
3.9.2 Governing Law: English law and jurisdiction apply.
3.9.3 Changes to Terms: We reserve the right to modify these terms at any time.

4. Dietary and Lifestyle Definitions

4.1 The following definitions apply to dietary and lifestyle terms used on the Site:

No Milk: Excludes all milk and milk-derived ingredients.

No Egg: Excludes all eggs and egg-derived ingredients.

No Nuts: Excludes all peanut and tree nut ingredients.

No Peanuts: Excludes all peanut-derived products and possible traces.

No Soya: Excludes soya, soya lecithin, and related ingredients.

No Gluten: Excludes barley, rye, wheat, kamut, spelt, and oats.

No Fish: Excludes all fish products or traces.

No Shellfish: Excludes crustaceans, mollusks, and related ingredients.

No Celery: Excludes celery and celeriac products.

No Mustard: Excludes mustard products and traces.

No Sesame: Excludes sesame and sesame-derived ingredients.

No Lupin: Excludes lupin and lupin-containing products.

No Lactose: Excludes products containing lactose.

Vegetarian: Excludes animal products except milk and eggs.

Vegan: Excludes all animal products and by-products, including milk, eggs, and honey.

Halal: Products certified as Halal according to labelling.

Kosher: Products certified as Kosher according to labelling.

5. KM Food Store Parcel Returns

5.1 Returning Parcels

5.1.1 Items must be returned in accordance with our Returns Policy via third-party carriers, as KM Food Store does not handle deliveries directly.

5.2 Return Conditions

5.2.1 Parcels must be:

1) Securely packaged

2) In original packaging

3) Labelled with the return label on the outside

5.3 Proof of Return

5.3.1 Refunds are typically processed within 14 days of receipt of returned goods.
5.3.2 Retain proof of collection from the third-party carrier as evidence of return.
